AVAAZ.org: Άμεση τροποποίηση του Σύμφωνου Συμβίωσης για να συμπεριλαμβάνει τα ομόφυλα ζευγάρια

Υπόμνημα έχει δημιουργηθεί στην ιστοσελίδα του AVAAZ.org, το οποίο και θα παραδοθεί στον Υπουργό Δικαιοσύνης Χαράλαμπο Αθανασίου, προκειμένου να απαιτήσουμε την άμεση τροποποίηση του Σύμφωνου Συμβίωσης για να συμπεριλαμβάνει τα ομόφυλα ζευγάρια!

To 2008, ετέθη σε ισχύ ο νόμος 3719/2008, ο οποίος αφορά στη δυνατότητα σύναψης Συμφώνου Συμβίωσης μεταξύ ατόμων διαφορετικού φύλου, αποκλείοντας όμως το δικαίωμα της σύναψης από άτομα του ιδίου φύλου. Ο αποκλεισμός αυτός συνιστά κατάφορη παραβίαση της Ευρωπαϊκής Σύμβασης για τα Ανθρώπινα Δικαιώματα (Άρθρο 14 μαζί με το Άρθρο 8) όπως και παραβίαση του Ελληνικού Συντάγματος (Άρθρο 4, Παράγραφοι 1 & 2). 

Πέντε χρόνια μετά, το Ευρωπαϊκό Δικαστήριο Δικαιωμάτων του Ανθρώπου (Ε.Δ.Δ.Α.) του Στρασβούργου, δικαιώνει τα εννέα ενάγοντα άτομα που προσέφυγαν σε αυτό μηνύοντας την διάκριση σε βάρος τους, και καλεί την Ελλάδα να καταβάλει 5.000 ευρώ (χρήματα που θα πληρώσουν οι Έλληνες πολίτες από την τσέπη τους) σε κάθε άτομο.

Το νέο αντιρατσιστικό νομοσχέδιο που θα ψηφιζόταν άμεσα προέβλεπε τη δυνατότητα σύναψης σύμφωνου συμβίωσης και για τα ομόφυλα ζευγάρια, όμως ο Μητροπολίτης Πειραιώς Σεραφείμ απείλησε με αφορισμό τους βουλευτές που θα υπερψήφιζαν το Σύμφωνο (πράξη που αντίκειται στο γράμμα του Συντάγματος, του Νόμου αλλά και των ίδιων των Χριστιανικών αρχών), ενώ υπήρξαν αντιδράσεις και από βουλευτές του ενός από τα δύο κυβερνώντα κόμματα (Ν.Δ.). Έτσι, η τροπολογία μπήκε για άλλη μια φορά στο ντουλάπι.

Ζητάμε από τον Υπουργό Δικαιοσύνης Χαράλαμπο Αθανασίου την άμεση τροποποίηση του Σύμφωνου Συμβίωσης για να συμπεριλαμβάνει τα ομόφυλα ζευγάρια ώστε να μπορούν να δημιουργούν - με την απόλυτη προστασία του κράτους απο όλες τις πλευρές - οικογένειες τους και να μεγαλώνουν τα παιδιά τους με ασφάλεια και αναγνώριση.

In 2008, a law (3719) was passed in the Greek Parliament allowing a man and a woman the option of signing a Civil Partnership contract as an alternative to marriage; however, same-sex couples were excluded from this option, which would have been the only way for them to enter a legally recognized union. This exclusion constitutes a blatant violation of the European Human Rights Agreement (articles 8 and 14), as well as a violation of the Greek constitution (article 4, par. 1-2) guaranteeing equal rights to all Greek citizens.

Acknowledging this violation, five years later The Supreme Court of the European Union - The European Court of Human Rights in Strasburg found for the nine gay and lesbian plaintiffs who had sued the Greek state for discriminatory treatment, and is now forcing Greece to pay a 5.000 compensation euros to each plaintiff—money that the crisis-burdened Greek citizens, not the over-privileged politicians, will be called upon to pay.

In response, the new anti-discriminatory legislature that was up for ratification by the Parliament last month included a clause that would extend the Civil Partnership option to same-sex couples. However, the bishop of Piraeus, Seraphim, threatened all MPs who would vote for this clause with excommunication, an act of interference with the affairs of the State that violates the principles of the Greek Constitution, let alone the principles of love on which the Christian faith is based; at the same time, reactions were voiced by a small group of MPs belonging to one of the ruling parties (i.e.New Democracy). Thus, once more, this piece of equal-rights legislature was shelved indefinitely.

We ask that the Minister of Justice, Charalambos Athanasiou, immediately modify the Civil Partnership law so that it extends to same-sex couples. We support the right and the wish of same-sex couples to enter into recognized unions with their partners and confer upon them benefits accorded to all heterosexual spouses, as well as the right to raise their children safe from fear, insecurity, marginalization, or discrimination.
